Evidence Is Everything

Your R&D Tax claim is only as strong as the paperwork behind it. Without the right documentation, your consultant physically cannot claim your full entitlement — regardless of how genuine, extensive, or expensive your R&D work has been. The ATO does not accept verbal explanations or reconstructed records at audit time.

You also need to demonstrate a genuinely scientific approach — generating new knowledge, not just developing products. The legislation requires both R and D. If your records don't show both, the claim is at risk.

The Online Claim Form Is a Trap

Changes introduced in July 2021 mean the application form now asks questions that your records may not be able to answer. Inadequate answers actively trigger an audit flag. Once flagged, you have 30 days to respond to an information request — and if your records aren't organised, the consequences escalate quickly.

AusIndustry will inspect for specific artefacts: product strategy, project hypotheses, eligibility documentation, timelines, time and materials records, experiment plans and results, and meeting minutes. If any are missing, you are already exposed.
